Linda Evangelista, you and even worse, your adorable son Augustin (Augie) by billionaire Francois-Henri Pinault, could have been burned in the nasty child support war that went into Manhattan court, starting May 3.

That’s because your  demand for $46,000 a month was so over – the- top  nutso, celebrity divorce attorney Raoul Felder, told Hollywoodlife.com exclusively. “Sometimes it doesn’t hurt to ask for a lot of money in a child custody battle, but it can hurt a case like this because it’s so absurb. It accentuates that she’s trying to get mom support.”

The problem with “silliness” as Felder described your demand for $15-$16k just in car service and bodyguards for your son with Pinault, and for $90,000 in vacation cash, was that it could annoy the judge presiding over the case and it could have infuriated the father of the child, in other words – Pinault – who holds the purse strings.

“Pinault, Evangelista’s billionaire ex-boyfriend, who is now married to superstar Salma Hayek, had repeatedly tried to work out a child support agreement with you, since little Augie was born, but you had demanded more than he was willing to spend.

“Once a father is forced to go to court, he’s usually ready to dig in his heels. He’s angry,” Felder warned. Often that means that a settlement that had been previously offered is taken off the table.”

That means that not only could you, Linda Evangelista, have been awarded far, far less by the magistrate presiding over your case BUT you could have blown a good deal that Pinault probably offered for years and had now withdrawn. You would have been stuck with whatever the judge deemed was reasonable for your sons needs.

“The judge is a human and he or she is presiding over cases every day where mothers who are getting $50 a week are begging for $10 more,” explained Felder. “The problem for Linda is that a carton of milk costs the same for a supermodel’s child and for the child of a mom who is really needy.”

The magistrate is going to look at the child (Augie’s) needs for food, accomadation, school, etc. and that’s it. He’ll look at the numbers for the child. Support is based on what the child needs. It doesn’t matter how rich the father is. The law doesn’t care.”

Whoa! So the fact that you Linda had a baby with a billionaire doesn’t entitle little Augie to live like a billionaire’s child! Or you!

Child support also isn’t based on whether Pinault dumped you when you were pregnant, says Felder.

“There’s no such thing as reparations in child support and tarring” your ex by saying he wanted to terminate the pregnancy ( as happened here), also has no impact on the judges’ decision on the amount that would be awarded for support, points out Felder.

The most that has EVER been awarded for child support in New York state is $19 thousand a month to Misa Hylton-Byrn, the ex-girlfriend of Sean “P. Diddy” Combs, the mother of his son Justin, now 18.

So Linda – $46k was a HUGE reach, even by celeb standards. Even your request for round-the-clock bodyguards and drivers was ridiculous. As Raoul Felder pointed out – very fortunately we don’t have a child kidnapping problem here in the US. Thank God!

Listen, I’m just relieved that Francois-Henri Pinault DIDN’T let his fury with you dragging him into court with unreasonable demands, influence how he felt about taking care of little Augie. Clearly, he made you an offer you can live with. We learned from a courtroom eyewitness that you and Francois were talking inside the courtroom and looking satisfied. So Augie will be well provided for.

That’s what a Pinault insider had already told us at Hollywoodlife.com exclusively. “Francois is only concerned with the well-being of his son and wants him to go to the best schools, have the best healthcare – he will never want for anything,” a Pinault insider said.

Well, Linda, I’m glad you didn’t blow that deal and let’s hope you realized how close you came to pissing off your non-deadbeat baby daddy in a big way, and that would only have hurt Augie.

Lawyers will be busy doing paper work this evening an insider close to the child support battle tells HollywoodLife.com exclusively. Fortunately the warring parties Linda Evangelista and Salma Hayek’s husband, billionaire Francois-Henri Pinault have reached a deal in principle on support for adorable son Augustin (Augie) 5, in court today.

Their lawyers will be ironing out the details immediately, a source close to the situation, tells Hollywoodlife.com. “Both appeared relieved in court today. Linda and Francois spoke together both inside and outside of the courtroom for the first time today,” a courtroom eyewitness tells us.

The settlement will be for less than the $46,000 a month that Evangelista had requested in court, the source close to the situation, tells Hollywoodlife.com.

The paperwork may be completed tonight. Whew!

As stunning supermodel Linda Evangelista, 46, and fashion business billionaire Francois-Henri Pinault face off in for a third day in court today, May 7, Hollywoodlife.com has learned from a Pinault insider, that the French father is hardly the deadbeat dad that Evangelista’s lawyer, William Beslow, has painted in court.

While he doesn’t want to pay $46,000 a month in child support for son, 5-year-old Augustin, known as Augie, because he sees much of it as “mom support” for Linda, he has repeatedly tried to reach a child support agreement, to no avail.

“Augie will never want for anything. He will go to the best schools and have the best health care and Francois is already paying for all this now. His only concern is for Augie,” a Pinault insider tells HollywoodLife.com.

“No matter what happens in this trial, Francois will always have an incredibly close relationship with his son. He’s loved him ever since he was expecting him,” says the insider who insists that contrary to Evangelista’s bombshell claim in court – he never asked her to terminate her pregnancy.

While it’s been reported that Pinault has not been interested in paying child support, the insider says that the French businessman, who is married to superstar actress, Salma Hayek, 45, contacted Linda’s attorney after Augie was born and tried to work out a child support agreement. Hollywoodlife.com has learned that her attorney made a proposal, which Pinault thought was too high. He countered that proposal and then received no definitive response for three years. When Linda hired a new attorney, William Beslow in 2010, Pinault’s attorney again reached out trying to formalize child support. Beslow responded with an agreement which included both child support for Augie, as well as requests for Linda. When Pinault didn’t accept that “settlement,” Evangelista filed suit.

“The trial is a last resort. Francois doesn’t want to put his son through it or go through it himself , but Linda Evangelista’s demands weren’t reasonable. They didn’t pass the smell test,” says the insider.

The largest child support settlement ever awarded in New York state, where Evangelista lives, thus far has been for $19 thousand a month, to Sean (P Diddy) Combs‘ ex, Misa Hylton-Byrn for support of their son, Justin, now 18.

While Pinault is the heir to a family fortune of $11.5 billion, he has no access to those funds, according to the insider. He lives on his $4-$5 million salary as CEO of Pinault-Printemps-Redoute, which owns Gucci, Yves Saint Laurent and more. While that is a huge amount, the insider contends that $46,000 a month is a quarter of Pinault’s post-tax take home pay.

However, Evangelista doesn’t have to worry about her son being taken care of in Pinault’s estate. According to French law, he will inherit the exact same amount as Pinault’s three other children including his younger half sister, Valentina, 4, who’s mom is Salma Hayek.

What’s being contested in court are expenses like the $15,000-$16,000 a month in charges for car service and security, $7500 a month for vacations and the cost of an extra apartment to be rented near Augie’s school, so he can have play dates there.

What’s so sad here is that, relations between Evangelista and Pinault have been good enough until now, for Pinault to see his son several times a year – every time he is in NYC, for Salma and Valentina to have play dates with Augie and for Pinault to call Evangelista an “excellent mother” in court.

Now, however, the disturbing accusation was made in court by Linda’s lawyer, that Pinault wanted Evangelista to terminate her pregnancy . While the insider insists to Hollywoodlife.com that Pinault never said or wanted that, little Augie, will read that accusation one day. Meanwhile, Pinault is apparently looking forward to the trial ending on Tuesday, so he can see his son, before he goes back to Paris.

The magistrate’s decision on support could come at the end of testimony on Tuesday, May 8, or could take months.
