We weren’t surprised yesterday when Charlie Sheen, 45, filed for divorce from his wife Brooke Mueller, 33, after two tumultuous years of marriage. But what stunned us is the fact that Charlie is seeking joint physical and legal custody of the couple’s 19-month-old twin sons, Bob and Max, and that he thinks he’s actually fit to take care of the kids at all!

Brooke Mueller, 32, has officially flown the coop, RadarOnline.com is reporting. After learning that husband Charlie Sheen, 44, allegedly cheated on her (in their home!) with a woman named Angelina Tracy during his stint in rehab, she’s absolutely had it! Though Charlie denied the affair — he claimed the woman he was photographed with was “the sister of one of [his] campmates” — Brooke has apparently made up her mind. Although they love each other, is it healthy for two abusers to stay together? “If Charlie and Brooke are committed, then it’s better to work though it to become a tighter family and team,” Celebrity Rehab and Sober House psychiatrist Dr. Charles Sophy tells HollywoodLife.com, “It’s also important for them to look back and see they’ve had this pattern before. They have to get it together or they will continue like this.”

Brooke Mueller proved that she wanted to get help for her alleged substance abuse relapse by checking in to North Carolina drug and alcohol rehab center Two Dreams Outer Banks in late January following a domestic violence altercation at Christmastime with husband Charlie Sheen, 44. But will failing to complete her rehabilitation treatment program jeopardize her chances of keeping 9-month-old twins Max and Bob?

If Brooke Mueller and Charlie Sheen do separate in the wake of the messy domestic dispute that occurred over Christmas, child services won’t be so quick to grant Brooke custody of her one-year-old twins Max and Bob. Now that she’s checked herself into the Two Dreams Outer Banks drug and alcohol rehab facility in North Carolina for alleged crack addiction, a court may rule that she isn’t a fit mom.
“Child Protective Services look at a few things, including the past history of parents and the current happenings,” Los Angeles-based family attorney Michael G. Dave explains exclusively to HollywoodLife.com. “It obviously doesn’t look good that she’s checking into a facility that looks like rehab because that seems like she’s still using.”
Charlie Sheen and Brooke Mueller aren’t going to win any awards for Parents of the Year, that’s for sure!
But is their drinking and fighting really going to affect their nine-month old twins, Bob and Max?
