Brian Austin Green, 47, has responded to Megan Fox‘s divorce filing by asking for joint custody of their three sons: Noah, 8, Bodhi, 6, and Journey, 4. The Beverly Hills, 90210 star is asking for both physical and legal custody in the court documents that were filed on Nov. 25, and obtained by HollywoodLife on Dec. 7. We have reached out to Brian’s and Megan’s reps for comment.
Brian did not check off the box requesting child support in the court documents, although he did request for possible spousal support that would be paid to both him and Megan. On the contrary, Megan requested to “terminate” the possibility for her or Brian to receive spousal support in court documents that were also previously reviewed by HollywoodLife.
Another difference between Brian and Megan’s court documents was the date of separation that they separately reported. Brian listed March 5 of 2020 as the day they officially parted ways after 10 years of marriage, while Megan wrote that they split in Nov. 2019 (which would be over a year ago). Megan filed her divorce petition, due to “irreconcilable differences,” on Nov. 25 — the very same day Brian filed his response with the Los Angeles County Superior Court. Brian and Megan have been married since 2010, although Megan filed for divorce the first time in 2015.
Brian confirmed that he and Megan split once again on the May 18 episode of his podcast, …With Brian Austin Green. From the beginning, the actor made it clear that they would always be a united family unit, no matter their romantic status. “I will always love [Megan]. And I know she will always love me and I know as far as a family what we have built is really cool and really special,” Brian said on the podcast. He added that they would “still do family vacations and holidays as a family and really make that a focus for the kids.”
However, Megan did call out Brian over a matter involving one of their children amid the separation. On Halloween, Brian shared a photo with his youngest son, Journey, and Megan hopped into the post’s comments section to make it clear she was upset. “Why does Journey have to be in this picture? It’s not hard to crop them out. Or choose photos that they aren’t in,” the Transformers actress wrote. She then explained, “I had a great halloween with [the kids] yesterday, and yet notice how absent they are from my social media. I know you love your kids. But I don’t know why you can’t stop using them to posture via Instagram. You’re so intoxicated with feeding the pervasive narrative that I’m an absent mother, and you are the perennial, eternally dedicated dad of the year.”
Since the split, Brian and Megan have pursued new love interests. Brian has been spotted out and about with women like Tina Louise, 39, and Courtney Stodden, 26, throughout quarantine, while Megan has been in a serious relationship with her co-star from the upcoming movie Midnight in the Switchgrass, Machine Gun Kelly, 30, ever since they were first spotted together in May.
