While Brad Pitt has been accused of allegedly abusing his children, he could still get 50/50 physical custody, according to a divorce attorney who spoke to HollywoodLife.com EXCLUSIVELY. Find out why after the jump!
“I assume [Brad Pitt] be seeking a 50/50 custody and visitation schedule,” Los Angeles Divorce Attorney David T. Pisarra of Men’s Family Law told HollywoodLife.com EXCLUSIVELY. “Given his huge resources this should not be a real problem, the only question is whether the judge will order it as being in the children’s best interests.
“Most experts today believe that a 50/50 [physical custody] is in the children’s best interests but some judges are still biased towards the mother,” David continued. “In Los Angeles County the judges are very open to a 50/50 custodial timeshare, if the parties’ schedules allow for the children to maintain their lifestyle, school choice and access to friends.”
The mother in this case is Brad’s soon-to-be ex-wife, Angelina Jolie, 41. Angelina filed for divorce on September 19, and while she cited “irreconcilable differences” in her docs, it was soon revealed that Brad had been accused of child abuse. Brad allegedly put his hands on his son, Maddox Jolie-Pitt, 15, during an incident on their plane. Brad has also been accused of having a problem with substance abuse. It appears that despite these serious claims, he could still get joint custody; Angelina asked for sole physical custody and visitation rights for Brad in her divorce docs.
This would obviously be great for Brad, who is desperately missing his children and reportedly begging to see them. Angelina has rented a massive Malibu home and allegedly barricaded herself and the children inside to escape the prying eyes (and questions) of the paparazzi, and also allegedly blocked all of Brad’s calls and texts!
Getting 50/50 physical custody might be even easier for Brad, actually. It’s unlikely that the child abuse claims will be pursued, according to Divorce Attorney & Family Law Expert Raoul Felder, who also spoke to HollywoodLife.com EXCLUSIVELY. This is because there was no third party evidence to back up the alleged incident between Brad and Maddox, Raoul said. If a flight attendant, for example, were to come forward, then that could be different.
