Steven Avery, 53, has not given up hope of becoming a free man. The Making A Murderer subject claims that one of the jurors who convicted him was tainted and repeatedly told the others that Steven was “f–king guilty” which helped sway their decision. Does he stand a chance at freedom this time?
Steven Avery has just filed a brand new appeal against his murder conviction, in hopes a judge will throw it right out with the trash. The appeal claims that one of the jurors who found him guilty in the 2005 trial for photographer Teresa Halbuch‘s murder was “tainted” and had it out for Steven the whole time, reports TMZ.
Apparently the juror called Steven “f–king guilty” multiple times throughout the trial, and even told the other jurors, “If you can’t handle it why don’t you tell them [the judge] and just leave.”
But, that’s not all. The appeal also claims that the search of his private property, which resulted in the discovery of incriminating evidence against Steven, was illegal. How? The length of time his property was searched “exceeded” the time allowed on the warrant. Whoa!
The appeal also states that when Teresa’s car was discovered on Steven’s property, it was not properly sealed off with evidence tape which allowed many of the on-site officers to open and close doors. This goes with the well-supported theory that evidence was planted to help find Steven guilty, including his own blood.
If Steven’s appeal were to go through, the Wisconsin State of Appeals would officially declare his murder trial a “mistrial.” This would allow Steven to walk free again just ten years after being arrested and locked up for Teresa’s murder. Whether or not there would be a new trial remains to be seen, but don’t forget that even prosecutor Ken Kratz revealed that Steven might actually deserve one.
