When Kelly Rutherford lost custody of her two children in a shocking ruling by a judge in Monaco we were all puzzled. But now it turns out that the Monaco court feared Kelly would ‘abduct’ her two kids and never let them see their father again.
This is so sad! Not only did Kelly Rutherford, 47, lose custody of her two children Hermes, 9, and daughter Helena, 6 but the judge ruled that Kelly would never be able to bring them to the United States. TMZ claims to obtained the written ruling and they’ve reportedly learned why Kelly’s was dealt such a tragic and harsh blow.
In a written ruling reportedly obtained by TMZ, the judge wrote that his reasoning behind granting full custody to their father, Daniel Giersch was because there seemed to be “a strong risk of the children’s abduction and retention in the United States.” Meaning the judge felt Kelly would attempt to keep the children in the United States. Which isn’t too far off base because over the summer she refused to send her kids back to their father and kept their passports until a judge demanded they go back.
In the ruling it’s stated that Kelly may only “exercise her visiting and accommodation rights exclusively in France and Monaco.” This means that every single time she wants to see her kids, she will have to fly overseas and that gets pricey! But the court order claims that both parents must make decisions together on “health, schooling, religious education and any change of residence.” The judge also ruled that the kids would be able to spend half of Christmas, spring and summer vacations each parent — but still do difficult!
We are just so sad that it’s come to this and hope that maybe in the future Kelly and Daniel can resolve things but this doesn’t sound fair for anyone involved, especially the children.
