Charlie’s announcement on The Today Show on Nov. 17 that he’s HIV positive was shocking. But what’s maybe even more shocking was how far Charlie went to protect his secret. In Touch has released the non-disclosure agreement that every person he had sex with was asked to sign. TMZ says even regular guests at his home had to sign a contract of secrecy. First of all, by signing the papers, partners are agreeing to keep all communication, personal info and anything that goes on with Charlie, private. If they don’t, they’ll be forced to pay a $100,000 fine plus however much damage it causes him. Not only can they not tell media, they can’t even tell family or friends. That’s tough.

There’s been a lot of talk about potential lawsuits if Charlie didn’t disclose his HIV positive status to his partners, but his agreement planned for that too. Partners waived their right to go to a regular court, instead agreeing to use an arbitrator – a person outside of courts that settles disputes. “By agreeing to arbitration, we are giving up any rights we may have to a trial by a judge or jury with regard to the matters which are required to be submitted to mandatory binding arbitration,” the agreement says. “We understand, acknowledge and agree that there is no right to an appeal or a review of an arbitrator’s award as there would be of a judge or jury’s decision.” So basically, if you lose, it’s over.

Despite all of these precautions, Charlie ended up outing himself. Why? Perhaps it’s the millions in blackmail that TMZ is reporting he paid to keep people quiet. Even though he didn’t tell many people about his HIV status, those that knew betrayed him. So sad.
