Lamar Odom: Jail Time For Allegedly Testing Positive For Cocaine? — Attorney Speaks

Is Lamar Odom facing jail time for allegedly using cocaine at Love Ranch South?! The drug was reportedly found in the ex-NBA star’s system when he was hospitalized on Oct. 13, and HollywoodLife.com has the scoop on whether or not he’ll likely do time behind bars because of this.

Lamar Odom has a long road to recovery…but is it going to end with time in jail!? HollywoodLife.com spoke with a defense attorney who explained why the former Lakers star will most likely be able to avoid doing time for his alleged drug use. To hear more about Lamar Odom and Khloe Kardashian, head over to iTunes and download the latest HollywoodLife podcast for free!

“In Lamar’s case, aside from his blood test, the available evidence is very shaky at best,” James Silverstein, Esq. told HollywoodLife.com EXCLUSIVELY. “No law enforcement officers personally observed Lamar ingest the cocaine, nor witnessed any of his conduct which could lead them to believe he was under the influence.” James added that, just like with DUI offenses, simply having cocaine in the system does not “definitely prove whether or not a person was under the influence.”

In summary, James is saying that there’s no “real proof” Lamar was using the drug. “With so many evidentiary hurdles to clear, not to mention that Lamar is now out of state, and the alleged crime is relatively low-level, it remains to be seen whether or not charges will be filed, an arrest sought, and extradition proceedings instigated.”

As James previously told HollywoodLife.com, Nye County detectives’ reasoning for running a blood test on Lamar is “very shaky,” because the evidence of the 35-year-old doing coke “is based almost entirely upon hearsay of third parties.” In case you forgot, Lamar reportedly told prostitutes at the brothel that he had done cocaine, but nobody actually saw him take the drug in any form. So, as James pointed out, Lamar’s attorney would likely motion to strike the blood test results since they were “unconstitutionally searched and seized.”
