Bruce Jenner, 65, is already a woman in his heart, but not yet legally. Though the Jenner patriarch has taken huge steps to complete his gender transformation, there are legal steps he must also take. From obtaining a court order to providing necessary documentation from a physician, HollywoodLife.com has the scoop from top legal experts on how Bruce will legally become a woman.
Steps Bruce Jenner Must Take To Legally Become A Woman
1) He must get a court order stating the kind of case the court will be hearing, along with submitting a request to change his old name to his new name and gender.
“Bruce would seek to change his gender through a court order. The gender change doesn’t happen automatically just because you change the name,” Michelle Lee Flores, attorney at Cozen O’Connor says. “He must ask the court and give the reasons why he wants his gender to be changed from male to female.”
2) Bruce must get a declaration from his physician.
Luckily for Bruce, it’s become a lot easier to legally change one’s identity, according to Susan Clary, an attorney with the Malibu law firm Harrison Barnes APLC.
“So long as a doctor certifies ‘appropriate treatment,’ it’s just a matter of filing the appropriate pieces of paper with the various State and Federal agencies,” Susan says. “After the arduous process of SRS, getting the State and Feds to recognize your gender is relatively simple. How far we’ve come in our societal view of gender change! Even a few years ago, the answer to your question would have been far more complex, but we now accept as routine a person’s right to publicly correct his or her gender.”
3) He must file forms including the physicians’ declaration of the change at the county courthouse and pay a fee if necessary.
4) Bruce will receive his court hearing date and attend the court hearing if necessary.
Since Bruce was born outside the state of California, these are the steps he must take. While it will be a process, Michelle weighs in that obtaining IDs will likely be his biggest challenge.
“One of the challenges Bruce Jenner will face is changing the gender identity on his IDs,” Michelle says. “For example, his driver’s license and passport because those usually say ‘sex’. It’s quite easy to change someone’s legal name, however changing one’s gender legally is not quite as simple.”
Bruce is reportedly very far along in his transition, and once he completes these legal steps he’ll be able to fully embrace life as a woman!
