After being thrown out of rehab twice, Chris Brown has ruined his chances of staying out of jail. It may not seem fair, but it’s the law, says Los Angeles attorney Mychal Wilson. Plus, “Mr. Brown remains a danger to the community” after he allegedly made threats about using guns while in rehab, says lawyer James E. Silverstein.
Chris Brown’s Trial Judge: Why He’s Keeping Singer In Jail & Refusing Bail
As Mychal Wilson explains to HollywoodLife.com EXCLUSIVELY, “Chris Brown will now remain in custody after a Los Angeles judge denied his request to be released from custody while he awaits trial for his D.C. misdemeanor assault charge. Chris Brown will now be flown back to Los Angeles via Con Air.”
Many Breezy fans are confused as to why Chris is being treated like this when most people in his situation — he’s not in for a huge crime — would be granted bail. But apparently it’s not that simple.
“Chris Brown’s situation is more complicated than meets the eye,” attorney James E. Silverstein tells us. “Factors the court will generally consider in deciding whether or not to grant bail include the recommendations of the probation officer (if there is one), the defendant’s criminal history, the conduct resulting in the alleged violation, whether the defendant is a flight risk, and whether the defendant is a danger to the community.”
Chris made a huge mistake when he allegedly made threatening gun comments while he was in rehab.
“The allegation appears to be that Mr. Brown allegedly made threats about using guns while in his court-ordered
rehabilitation program on that case,” James continues. “This is a serious allegation, and one that very well could have suggested to the court that Mr. Brown remains a danger to the community.”
Chris Kicked Out Of Rehab Twice
It’s important to remember that the judge did give Chris the chance to stay out of jail by sending him to rehab — not only once but TWICE. And both times he blew it!
“Last November, Chris Brown was sentenced to 90 days in a treatment program for his October arrest in the Washington, D.C. assault matter,” Mychal explains. “However, his probation report alleged Mr. Brown threw a rock and shattered his mother’s car window. Pursuant to the terms of his 2009 felony assault conviction, Chris Brown’s probation was revoked.”
And that’s not all.
“Subsequently, the judge allowed Chris Brown to stay out of jail if he entered a 90-day anger management and drug rehabilitation program,” Mychal adds. “But Chris Brown was kicked out of his second court-ordered drug rehab facility in mid-March for violating its program rules and regulations.”
Will Chris ever learn? Perhaps he is just too much denial to understand how much professional help he really needs.
