

Reese Witherspoon and her husband, James Toth, both had a brush with the law in the early morning of April 19 in Atlanta, Ga. when James was pulled over suspected for driving while intoxicated. The couple was arrested and briefly jailed according to the Atlanta Department of Corrections.
For those questioning whether it’s normal for a driver and a passenger to be arrested in a DUI case, you’re way ahead of us. While James was arrested and faces charges for DUI, Reese was taken in for disorderly conduct, our sister site Variety reports exclusively.
The 37-year-old actress was handcuffed after disobeying multiple instructions from an Atlanta policeman to stay inside the couple’s vehicle. Not only did Reese go against the officer’s orders, she also verbally abused him, according to the police report obtained by Variety.
“Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer,” the police report states. “I told Mrs. Witherspoon to sit on her butt and be quiet.”
James was pulled over after reportedly weaving across a double-lined street and driving on the wrong side of the road. According to the police report, he smelled of alcohol and later blew a .139 on a Breathalyzer test, well over the legal limit.
Both Reese and James were briefly jailed before being released on bond at about 3:30 AM.
The couple’s court appearances are scheduled for Monday, April 22 at 8 AM in Atlanta Municipal Court. However, neither James nor Reese are expected to appear at their hearings — reportedly their lawyer will ask that the proceedings be postponed.
Reese and James (otherwise known as Jim) were married on March 26, 2011 after dating for over a year. As an agent at CAA, Jim also represents Reese. The couple had their first child together — Tennessee — in September 2012.
