Prince William, you must be feeling so powerless to protect your lovely wife Kate Middleton, now that French magazine Closer has published her topless photos on its cover.

No doubt you feel violated and intruded upon. Who wouldn’t? But for you, it must feel even worse than it would for one of us regular folks or even for the average Hollywood star.

That’s because your dearly loved mother, Princess Diana of Wales, died at the young age of 36, after being hounded and literally chased by aggressive paparazzi.She was killed in a horrible car crash after a high speed car chase with a dozen paparazzi on motorcycles trailing her car.

You had to have been scarred by that experience. Losing a mother at a young age is life altering enough when it happens due to illness or an accident. But when you’ve lost your mom tragically due to privacy-invading fame, it is horribly unique.

Now, 15 years later, you must feel like you are reliving that terrifying and grief-stricken time.

Despite everything you’ve done to protect the woman you love, she has been violated by a photographer who snapped photos of her topless and bottomless while sunbathing.

“This has to be traumatizing for Prince William because he’s already lived this horror,” explained celebrity relationship expert Dr. Gilda Carle of drgilda.com. “Repeat of a trauma can be very very disturbing.”

Furthermore, this incident could be making Prince William, who is so responsible all the time, feel inadequate, which is a horrible feeling for a man, believes Dr. Gilda, the 30-second therapist on Today.com. “He may imagine that he has failed his wife in his protection and one of the things that a woman wants most is for her man to protect her. So he may feel that he’s let his wife down.”

And of course for William, this is a particularly sensitive situation because of his mom.

“What’s always looming over this couple is what scrutiny ultimately did to his mother in her tragic death,” psychologist Dr. Phil Dembo tells Hollywoodlife.com.

What’s going to be so hard, but so necessary for Prince William is that he has to come to terms with what he is able to control and not control as he tries to protect his family, points out Dr. Dembo.

After all he and Kate want to live as normal and open a life as they can. Probably one of the biggest reasons William loves Kate so much is that he CAN live a more normal “non-royal” life with her. He loves spending time with her non-royal family and even more he treasures spending time with Kate in their fairly remote, rented farmhouse on the Welsh island of Anglesey. That’s where she can shop and cook for him.

You have to feel for Prince William. Topless photos are just the beginning of his privacy worries. “This challenge for them, will pale in comparison to their attempts to protect the privacy of the birth of their children, and the privacy of their children’s developments,” points out Dr. Dembo.

Laurence Pieau, Editor of Closer, spoke out today and said that “one shouldn’t dramatise these pictures.” Keep reading to see what else she is saying!

Earlier today, St James Palace released an official statement saying they are suing the magazine: “St James’s Palace confirms that legal proceedings for breach of privacy have been commenced today in France by The Duke and Duchess of Cambridge against the Publishers of Closer Magazine France.”

‘Closer’ Magazine Editor Defends Decision To Publish Kate Middleton Topless Photos

But Closer Editor, Laurence Pieau, feels strongly that she did nothing wrong. ”These photos are not in the least shocking,” she told the Agence France-Presse on September 14. “They show a young woman sunbathing topless, like the millions of women you see on beaches.”

Pieau says the outrage over the photos being published is “disproportionate.” She says, “It is a young couple that has just been married. They are in love. They are beautiful. She is the princess of the 21st century.”

She also goes on to say that Kate was on the balcony in plain view from the road below. She says they are “full of joy and not degrading.”

Kate Middleton is reportedly going to sue Closer magazine for publishing her topless pics but is it really worth it? HollywoodLife.com has just learned from Avi Bitton, a top media law attorney in Paris, that the magazine will not get shut down and she’ll make little to no money from suing.

“Prince William and Kate can file for emergency proceedings which can be very quick,” Avi tells us. “The judge could issue a ruling within a couple of days. This first emergency summary proceeding is in order to withdraw from the internet the pictures and to get provisional damages.”

But here’s the problem, France doesn’t award punitive damages, which means the court will not order Closer to pay Kate any more money beyond what is “necessary” for the damage done.

“The court will not give you additional damages in order to punish the magazine,” Avi explains. “In France, for the usual case, even if you are a TV star, or well known, usually the vicitm gets five to 15 thousand euros [between five and 20 thousand US dollars]. So basically, in the French system, tabloids, they are very encouraged to publish those pictures and breach privacy. Why? Because of course publishing those pics will bring them far more profit than loss.”

The only thing extra that Kate may get, is for her legal fees to be partially paid but according to Avi, it’s only a few thousand dollars — shocking!

In the photos of Harry, exclusive to TMZ, Harry was spotted showing the full monty during a game of strip billiards in a room full of friends in his VIP suite on Friday, Aug. 17. According to the report, Harry and his entourage met a group of women at the hotel bar, invited them up to the suite, and then went wild.

Both scandals seem humiliating, but we must remember that they are human — just like us!

Kate Middleton and Prince William are suing Closer magazine for plastering topless pics of her vacationing in the south of France and HollywoodLife.com can explain exactly how this notorious magazine got away with it in the first place!

We spoke with top France-based media attorney Avi Bitton, who tells us that publishing a photograph of anyone without their permission in France, regardless of their stature, is absolutely illegal.

“Under French law there is a right to privacy like in England and the US and it is protected by law,” Avi says. “In France that image of someone is part of their privacy. If for instance you take a picture of someone shopping on the street, one could think that it’s not private because you are shopping in public. But in France, taking this picture and publishing it is a breach of privacy because your picture is part of your image and your privacy.”

Avi explains that there are two issues, first off, the picture was taken without Kate’s permission — first breach of privacy. Next, he actually sold the photo to Closer, which is another breach because he’s distributing this without her approval.

“The legal issue is not whether she is topless or not,” Avi explains. “Even if he had just taken a picture of her face without her authorization, whether or not her face is well-known, it’s not the point. It’s unauthorized! The damage is much more because she is topless because she is part of the royal family. She has an image and reputation to protect.”

Kate and William are reportedly suing Closer, but they will have to do it in France because it’s under French law. Unfortunately, the courts don’t fine the magazines very much for something like this, and it’s unlikely the magazine will be shut down.

If Kate had been photographed topless at a private residence in the United States, it would not be illegal for a magazine to publish the pictures, only if she was in plain sight.

“The issue is that any place you can be seen from, you can be photographed from,” Barry Chase, a Miami-based attorney at ChaseLawyers tells HollywoodLife.com. “You’re subjecting yourself to being seen there. If someone tries to come into your house, or the actual place she was at there were trees and the photographer snuck onto shore and crouched in the bottom of the bushes [it's an invasion of privacy].”

Kate Middleton Sunbathing Topless — No Place Is Safe

You can’t go out as you did even at a supposedly remote chateau in Provence, France owned by one of Queen Elizabeth‘s nephews, Lord Linley.

The pictures appear to be taken on a balcony and you and William are adorably and lovingly rubbing sun lotion on each other and you have your arms around each other.

In the best of all worlds, it would be wonderful if like many women, especially European women, you could enjoy the freedom of sunbathing topless. But unfortunately, you are a HUGE paparazzi target and photos of you au natural can command a huge price.

William And Kate’s Reaction To Photo Scandal

Now of course you are feeling “anger” and “disbelief,” according to a spokesman. Anyone, royal or not, would feel this way about such an enormous invasion of privacy.

“Their Royal Highnesses have been hugely saddened to learn that a French publication and a photographer have invaded their privacy in such a grotesque and totally unjustifiable manner,” according to a statement released by your aides. “The incident is reminiscent of the worst excesses of the press and paparazzi during the life Diana, Princess of Wales, and all the more upsetting to the Duke and Duchess for being so.”

This aspect of the awful situation just must be so hard for your loving husband, Prince William. He loved his mother, Princess Diana so much, and he has clearly wanted to protect you from the traumas that his mother experienced while she was hounded by the press.

Her death in a car crash during a paparazzi chase, is the nightmare that haunts him. So this privacy invasion must be all the more horrific for him.

And in fact, he looks grim in photos this morning in Kuala Lumpur, where you are on a Royal Tour.

But Kate, you and William are doing the right thing — carrying on bravely with your work on the Royal Tour and investigating your legal options against Closer, the French magazine, which published the pictures.

Why The Queen Has Never Been Caught Topless

Now listen to me and to Piers Morgan, Kate. Piers tweeted: “Of course Kate’s entitled to privacy, and this was a grotesque invasion, but sunbathing topless near a public road’s just daft,” and “There’s a reason the Queen’s never been photographed topless or playing naked billiards. It’s called, ironically, ‘common sense.’”

Yes, Piers is a little harsh, but he does speak the truth.

Kate, you’re a wonderful woman and role model, try not to be too upset about this, and from now on, when you’re outside, keep your top on!
