1. It all started in Cancun.

Lawyers for Von, 27, reportedly petitioned a Los Angeles Judge on Nov. 8 to bar Elizabeth Ruiz from “selling or commercially exploiting” a sex tape with her and Von, according to The Smoking Gun. Von reportedly “engaged in consensual sexual intercourse” with Elizabeth (a model/actress) during a trip to Mexico in June 2016. The two were part of a group (which included Von’s male friends and other women) who stayed at Miller’s rented beachfront residence in Villa Albatros.
2. He knew he was being recorded the whole time.
The court documents list the defendant (aka Von) as “DOE,” though many sources have confirmed to TSG that it’s Von. The documents claim that Von was aware that she was recording the alleged sexual acts on her cell phone, but reminder her to “erase the recording” when they got back. “Gotcha,” Elizabeth reportedly responded, according to the court docs.
3. Elizabeth was willing to give Von the alleged tape – for a price.
Elizabeth allegedly shopped the tape around according to the documents, even trying to sell it to TMZ (TMZ claims they shot her down.) That’s when she offered to give the video to Von but not unless he paid $2.5 million dollars. Yikes!
4. Sorry, pervs. Von sacked the tape’s release.
It seems that the judge agreed with Von’s lawyers that Elizabeth’s demands are “extortion,” as the claim in the court documents. A temporary restraining order was issued on Nov. 15, blocking her from releasing or selling the video.
5. He may have the Hulkster to thank for this victory.
Elizabeth may not be able to find a buyer for the tape, especially after Hulk Hogan, 63, successfully sued Gawker Media into oblivion after the unauthorized release of his sex tape. “As we saw with the Hulk Hogan lawsuit any media outlet that publishes this footage would be liable and face serious ramifications,” Steven Hirsh of Vivid tells Fox News. “Consent is needed from both parties before any footage could be distributed.” When Vivid Video is hesitant to release a sex tape, it’s clear that the landscape has changed.
