The shocking trial of Derrick Rose resumed on Oct. 12, as the NBA star stands accused of gang raping his ex with two of his friends. Those other men took the stand to defend their actions, saying their group sex was completely consensual.
“She seemed into it,” Randall Hampton said about the alleged rape, according to The New York Times. “I thought she liked me.” This testimony was echoed by Ryan Allen, the third man (along with Derrick, 28) accused of sexually assaulting the New York Knicks guard’s ex-girlfriend in 2013.
“I did not rape her in in any form or fashion,” Ryan said. The former Wisconsin-Milwaukee basketball player (and younger brother of the NBA’s Tony Allen) maintained his innocence, claiming that his accused “was well aware of everything that took place.”
Ernest Lykissa, a toxicologist, also testified for the defense, saying that it was unlikely that Derrick’s 30-year-old ex was drunk by the time that the three men arrived at her apartment. Using a formula that measures intoxication based on amount of alcohol consumed over certain time periods (while taking in factors like a person’s weight and gender) the expert argued that the woman wasn’t drunk or passed out when the alleged attack happened.
The case may come down to three text messages. The defense argued that the omission of three text messages from evidence originally submitted by the woman’s lawyers could be used to clear Derrick’s name.
The defense argues that the text show the woman and a female acquaintance freely went to Derrick’s house earlier in the evening to have consensual sex. The judge, while saying the texts would be helpful to the jury, argued that their omission wasn’t enough to have the case thrown out.
Derrick’s accuser already gave her testimony, and she couldn’t hold back tears while her lawyer, Waukeen McCoy, read his opening statement on Oct. 5. As she wept, her lawyer accused the three men of taking turns raping her. Derrick, in his defense, said that his ex agreed to “sexual interaction with more than one co-defendant.”
