Holy moly! Brace yourself ‘Making A Murderer’ fans because this is HUGE! Steven Avery’s nephew Brendan Dassey’s conviction was allegedly overturned on Aug. 12, meaning he could be out of jail in 90 days! Does Steve have a shot at getting out too?! We have all the details right here!
We never thought we would see this day! Court reporters in Milwaukee tweeted that Brendan Dassey’s conviction for the rape and murder of Teresa Halbach, which was chronicled in Netflix series Making A Murderer, was officially overturned by a federal court on Aug. 12. Even more surprising? He could finally be out of prison within the next 90 days! OMG! If you’re a Making A Murderer fan, you probably feel like Steven Avery’s nephew (and Steve himself) should never have been in jail in the first place, so we are finally seeing some justice!
However, this doesn’t mean that Brendan is out of the woods. Court documents say that Brendan must be “released from custody unless, within 90 days of the date of this decision, the State initiates proceedings to retry him.” The judge also said that “in the event the respondent appeals this judgment, this judgment will be stayed pending resolution of that appeal.” Our fingers are SO crossed for Brendan!
Of course the whole story of Making A Murderer was shocking and infuriating, but perhaps the most tragic part was Brendan’s story. He was just 16 years old at the time, and his case was mishandled in SO many ways. He didn’t have a parent with him during his talks with police, he was coerced into saying certain things and fed lines, and somehow with zero evidence (except for a forced confession) he landed in prison where he has stayed for the past decade.
The judge explained what was so horrible about the actions of Len Kachinsky, Brendan’s original attorney. “The investigators repeatedly claimed to already know what happened on October 31 and assured Dassey that he had nothing to worry about,” the decision says. “These repeated false promises, when considered in conjunction with all relevant factors, most especially Dassey’s age, intellectual deficits, and the absence of a supportive adult, rendered Dassey’s confession involuntary under the Fifth and Fourteenth Amendments.” We hope he will finally be freed, and that Steve won’t be far behind!
