Kanye West and Taylor Swift continue to feud! This time, they’re battling it out because Kanye allegedly possesses a tape of Taylor on the phone with him approving “Famous” before it came out. We hear Kanye is planning to reference the recording when he drops the video for “Famous”, and California Attorney David Pisarra tells HollywoodLife.com whether or not Tay can take legal action if Kanye goes too far!
Pisarra tells us that while Kanye can release the alleged secret recording of Taylor, if he chooses to do so, she can take legal action. “Kanye West could release the tape of Taylor consenting to the song ‘Famous’ without too much legal recourse at his show in LA, even if Taylor did not consent to the recording. The likely only cause of action Taylor would have against Kanye after releasing the tape would be misappropriations of name or likeness. If Taylor decided to take Kanye to court for [it], she might receive minimal damages,” he explains. So it wouldn’t really be worth it for Tay to sue him, since she wouldn’t get much out of it.
However, Pisarra adds that Taylor has the option to protect her image by seeking a restraining order against Ye! “If Taylor wants to try and stop Kanye from disparaging her in public and damaging her reputation she can seek a judge who could order an injunction or restraining order to stop Kanye from mentioning her at his event in Los Angeles. Taylor would have to prove, among other things, that the event may cause irreparable harm to her.” Since Kanye using the so-called tape would make Tay look pretty bad, she probably would have an easy time compiling said proof.
Finally, Kanye “may be on the hook for financial compensation for damages to Taylor, who could also try to halt distribution of any new song or video he releases at the show”, Pisarra says. Yeezus had better tread carefully!
