Even though it’s been over a year since Tom Brady’s ‘Deflategate’ scandal, the saga continues in court and the drama exploded in the latest legal round of the case, and things aren’t looking so good for the Patriots QB now.
Uh oh! Tom Brady, 38, just took a worse hit than any sack he had during the 2015 NFL season, as the three judges U.S. Court of Appeals for the Second Circuit in New York are completely not buying his excuses in the “Deflategate” investigation. The case has come alive again after the NFL suspended him for four games, but Tom appealed and had that decision reversed by another judge. The NFL immediately filed an appeal, which was put on hold until after the season, which leads us to this.
On March 3, the NFL lawyers went before the three judge panel in hopes of a favorable ruling that league Commissioner Roger Goodell had the right to punish Tom and the New England Patriots for conduct “detrimental” to the game. Things went much better for them than they did for the NFL Players Association attorney Jeffrey Kessler, who was representing Tom.
The judges, particularly Barrington Parker Jr., focused on the fact that Tom destroyed his cell phone prior to his meeting with NFL independent investigator Ted Wells. “This all strikes me as hypertechnical,” he said. “You all had notice with the cell phone issue. Anybody within 100 yards of this case would have known that the cell phone issue elevates this merely from deflated balls to a serious issue of obstruction.” Judge Denny Chin also slammed the case, saying “The evidence of ball tampering is compelling if not overwhelming.”
The league is still trying to suspend Tom for those four games following the deflation of footballs in the Patriots 2015 AFC Championship win against the Indianapolis Colts. The case is now in the hands of the judges, who with a two-thirds vote could reinstate the suspension.
