Charlie Sheen revealed he’s HIV positive, but is he headed to a jail cell instead of his doctor’s office? Charlie admitted to having unprotected sex after discovering he had the disease and that’s a crime that could land him in the slammer!
Though Charlie Sheen, 50, got a huge weight off of his chest by admitting he’s contracted HIV, he may be in store for some stress with the law. After saying he had unprotected sex after he found out he had the disease, Charlie may have confessed to a possible felony that will put him behind bars. Uh-oh!
HollywoodLife.com spoke with Los Angeles attorney Mychal Wilson about the possibility of Charlie going to jail. “Any potential jail time for Charlie Sheen depends if the alleged victims can prove that he acted with specific intent to infect the person with HIV and the jury finds Charlie Sheen guilty ‘beyond a reasonable doubt’.”
Mychal Wilson also explained that a past lover could potentially win a lawsuit against Charlie if he didn’t disclose his HIV health status. “Depending upon the state in where the sex act occurred, Charlie Sheen’s sexual partner’s may file lawsuits under sexual battery and also under HIV disclosures laws such as California’s law which states: ‘Any person who exposes another to the human immunodeficiency virus (HIV) by engaging in unprotected sexual activity when the infected person knows at the time of the unprotected sex that he or she is infected with HIV, has not disclosed his or her HIV-positive status, and acts with the specific intent to infect the other person with HIV, is guilty of a felony punishable by imprisonment in the state prison for three, five, or eight years.’ ”
During the four years since he discovered he was HIV positive, Charlie said he had unprotected sex at least twice. However, “the two people that I did that with…they were completely warned ahead of time,” he said during his Nov. 17 TODAY show appearance, claiming he has done nothing wrong.
Still, Charlie may better get a lawyer, because he reportedly has plenty of past lovers angry with him for possibly exposing them to the disease. He’s allegedly the target of numerous lawsuits, as four women allegedly claim that Charlie put them at risk during sex.
Though law enforcement officials tell TMZ that no one has come forward with a complaint over Charlie, that may soon change. His ex, Bree Olson, blasted Charlie during an interview with Howard Stern. “So he just admitted right in that interview that,” he was HIV during his “Tiger Blood” phase. “That’s when I was with him!” Bree exclaimed, adding that Charlie “never said anything” about being HIV positive. Thankfully, she has been tested and is free of the disease.
Similarly, Charlie’s ex-wife, Denise Richards, she’s known about his condition for “a number of years,” but she hasn’t been “intimate” with Charlie since 2006. Denise has since tested her children — daughters Sam and Lola. Both girls, thankfully, do not have the disease.
