Kelly Rutherford isn’t going to keep quiet after a New York City judge ordered her to return her children to Monaco. The actress decided to fire back at Judge Ellen’s decision by saying she had ‘no authority’ to seize Kelly’s kids and force them to go back to their father.
It didn’t take Kelly Rutherford, 46, too long to react to Judge Ellen Gesmer‘s decision to send her kids back to Monaco! A day after Kelly said goodbye to Hermes, 8, and Helena, 6, in New York City, the actress released a statement saying the judge had ‘no authority’ to take away her kids. “What the judge did yesterday was shocking, illegal, and abusive to my children,” Kelly said in a statement to PEOPLE after she lost custody of her two kids at the court hearing on Aug. 11. “Without any legal authority, a judge from the lowest ranking court in the state court system violated the highest ranking deferral constitutional rights of my American citizen children.” The 46-year-old certainly did not hold back when she had a comment about the whole ordeal. Judge Gesmer wasn’t the only person Kelly criticized in her statement.
Kelly even slammed her ex-husband Daniel Giersch for not showing up to bring the kids home. “Knowing she had no authority, Judge Gesmer seized my children and their U.S. passports, and forced them to leave the United States and reside in Monaco, a country where neither they nor I, nor even their father, has citizenship,” Kelly continued to say. “The children’s father didn’t care enough about the children to be here himself. Contrary to his many false claims, he, like all German citizens, can come to this country anytime on his German passport. But he didn’t bother. I did my best to comfort the children, but there are no words to help children understand why a judge would be so cruel.” Although Kelly is upset over the judge’s ruling, at the end of the day she has to comply to Judge Gersmer’s order.
Judge Orders Kelly To Return Her Children To Monaco
When the former Gossip Girl actress refused to send her kids back to their father on Aug. 7 due to a court-ordered arrangement, that’s when the trouble began. Kelly was summoned to the court house in New York City on Aug. 11 after she decided to keep her kids in the United States. She was supposed to show up with Hermes and Helena, but instead showed up by herself. Sadly, the move to keep her kids away from the courthouse rubbed Judge Gesmer the wrong way, causing her to order Kelly to send her kids home to Monaco.
