Kourtney Kardashian may be taking care of her and Scott Disick’s three kids while he continues his partying binge, but that doesn’t mean he won’t be able to fight her for joint custody now that they’ve split! Despite the Lord’s wild past with substance abuse, an attorney tells HollywoodLife.com EXCLUSIVELY that Scott could still get custody!
Kourtney Kardashian, 36, has taken Scott Disick, 32, back countless times for the sake of their adorable kids, but it really seems like she’s done with him for good this time around. But what’s going to happen to Mason, Penelope and Reign now that their parents have broken up!? A family lawyer dished to HollywoodLife.com on the possibilities!
“Scott can still fight for custody, even with a history of substance abuse,” Kelly Chang Rickert, a certified family law specialist, tells HollywoodLife.com EXCLUSIVELY. “It may be an uphill battle and all depends on whether or not Kourtney will fight.”
But if the reality star is uncomfortable with her longtime partner getting custody of the kids, she has a chance to make her case, too. “Kourtney can hire a custody evaluator and insert all the instances of him being an unfit parent,” Kelly adds. “The evaluator will then come up with a report that is considered ‘evidence’ and can be used by the judge to determine a good parenting plan.”
Considering Scott was skeptical about even having kids, it wouldn’t be too surprising if he didn’t try to get custody. BUT, he could use this situation as a way to get some money from Kourtney. “Much to the chagrin of Kourtney Kardashian, Scott Disick may fight for joint custody of their three kids. Presumably, Scott Disick will dangle the child custody carrot to bargain for higher child support payments for himself. Basically, this means that Kourtney Kardashian will gain more custody time of their kids in exchange for higher child support payments paid to Scott Disick,” Los Angeles attorney, Mychal Wilson, tells HollywoodLife.com EXCLUSIVELY.
“Of course, then there is the possibility that the Kardashian Matriarch Kris Kardashian may have had Scott Disick sign a formal agreement regarding child and spousal shortly after Kourtney and Scott began dating in 2006 and right before their reality show Keeping Up With the Kardashians became a hit. And, if so, then the devil is in the details, and a formal agreement regarding this matter will dictate any custodial distributions,” Mychal explains.
Whatever does happen, we just hope Mason, Penelope and Reign are happy and in the best care possible. Sadly, though, it doesn’t seem like Scott has seen much of his cute kids over the last few weeks, as he reportedly hasn’t even shown up to the family’s Calabasas home in a month!
Kourtney finally decided it was time to pull the plug on her relationship with Scott after his recent trip to Europe, during which photos surfaced of him getting cozy with celebrity stylist, Chloe Bartoli. When he ignored all of Kourtney’s calls, she broke up with him over text message — something he didn’t even take seriously until he saw all the stories about it online.
