How heartbreaking. Kelly Rutherford was denied the right to bring her two young children, 8 & 5, back to the U.S. from France where they currently live with their father. It’s been an excruciating long six-year legal battle for the actress and it isn’t over yet.
Kelly Rutherford, 46, is the mother to two beautiful kids, son Hermés, 8, and daughter Helena, 5. But there’s a problem, the children were ordered to live in France with their father Daniel Giersch, by a California judge in 2012. The former Gossip Girl actress has been fighting for the past six years to get custody, but has been unsuccessful.
Kelly Rutherford Breaks Down After Losing Custody Battle
It’s been a long and emotional road for Kelly, and it’s not over. The actress is speaking out about the emotional toll of not being able to her two kids live in the United States with her. The two little ones are currently living in France with their dad, Daniel. Both parents previously were sharing custody, but when Daniel was unable to reenter the U.S. after traveling abroad, that all changed.
The court felt that it was only right the two children live primarily with their dad overseas, since he couldn’t live in the U.S and Kelly could travel to Europe to be with them. Her recent appeal to bring the kids back was denied once again.
“I know it’s not right. Parents know it,” Kelly tearfully told ABC News about the court’s decision. “Everyone knows it’s not right. My children, not only were they taken away, but they were sent to a foreign country.”
She added, “I can sit here and tell you how often I cry. I can tell you how it feels to leave my kids in a foreign country, to go see them after not seeing them for weeks on end, not being able to take them to school, pick them up from school, dress them, smell them, hug them.” So terrible, for both Kelly and her children.
Kelly’s Legal Battle Forced Her To File Bankruptcy
There’s also another issue, all of the grueling legal problems and costly trips across the ocean to see her children forced Kelly to file bankruptcy in 2013. Thus, adding to her fight to bring the kids back.
In the mean time, the California court mandated Daniel to continue to apply for a new U.S. visa in order to return with the kids, reports ABC News, but that hasn’t happened yet.
