Rumors have been swirling that everyone’s favorite power, Jay Z and Beyoncé, are planning on splitting up following the end of their ‘On The Run’ tour. Now, an expert is weighing in and telling HollywoodLife.com EXCLUSIVELY what a divorce would entail between the two.
Jay Z, 44, and wife of six-year, Beyoncé, 32, have been doing their best to remain a united front, but despite their best efforts, the rumor mill has continued to swirl that the two are headed for a split. Now an expert tells us if a battle over daughter, Blue Ivy, 2, is possible and who is like to get custody.

Leslie Barbara, is the chairwoman of the matrimonial department at Davidoff Hutcher & Citron. She has been practicing matrimonial law for 20 years, and has represented celebrity clients such as Michael Lohan, Molly Ringwald and Victoria Gotti during their divorces. Now, she is telling us exclusively what a possible split between Jay and Bey would look like.
“They should be divorcing in NYC based on their residency there and if there is a prenuptial agreement, they would still have to address issues with regard to their daughter, including custody, visitation and support,” Leslie said.”If there is no prenuptial agreement then we look to identify the marital estate, which are those assets that were acquired during the marriage– meaning, those assets that were acquired from the day you say “I do” to the day you say “I don’t”
“Infidelity should not sway the judge in a custody case unless the parental behavior was so inappropriate that it interfered with the parent’s ability to parent or they were so involved in the extracurricular affair that they were an absentee parent or not engaged as a parent.”
The couple have always put their adorable daughter first, as HollywoodLife.com previously reported, in fact the only time the couple speak is when they are discussing Blue.
“If there happens to be a custody battle- -which I do not anticipate,– a court would order a forensic analysis, which simply means the appointment of a doctor — typically a psychologist– to meet with Beyoncé and Jay Z and other family members, and housekeepers and nannies.”
“It is important to understand that if the matter were contested in court, the Judge would not order joint custody– because the presumption is that they cannot work together, otherwise they would not be in court fighting. So the court would order one parent as the sole custodial parent and then the other parent, named the “non custodial” parent, pays child support.– The child support figure is intended to cover costs such as housing, food, clothing etc.”
While divorce is painful for all parties involved, Leslie shared some words of advice for the couple.
“As for Beyoncé, there is no way to get around the pains of divorce; if the marriage does end, she is going to have to go through the process. I would surround myself with good friends and family and have a support system in place,” Leslie said. “She will come out on the other side stronger; I am confident of that.”
We agree Leslie, we are positive that no matter what, these parents will always put Blue first.

Gwyneth herself has been going through a similar situation, while separating from her now ex, Chris Martin. The two have been able to split in a very civil and friendly way, so she is definitely a good one for Beyoncé to be turning to.
Family will always have your back, and Solange has proved that many times to Beyoncé, even getting physical with Jay in her sister’s defense. Jay and Beyoncé have been in each others lives for such a long time, that we are confident that they will be able to do what is right no matter what, and always be there Blue Ivy.
