Women Judges in the Family Courts are much harder on women than their male counterparts. Female Judges have no empathy for other women they like being tough and nasty it makes them feel good and they can then say I put her in her place I am the only star in this courtroom.If the ex is involved in criminal acts who knows the sort of people he is involved with that puts the children safety at risk .All the big show at the airport big Super Mama signs and balloons those ideas did not come from the children neither of them could write Super Mama or decorate the sign He is trying to look like Father Of THe Year, I bet Kelly saw through that, most people with a brain would have.He either wants her back or he wants to get even for her leaving him.Co parenting what a joke when she has to live so far away so she can pay her legal fees and flights to see her children and her hotel bills so her and the children have some where to stay when they are together and she also would have to hire a car , while he lives with his Mother and her boyfriend. SHAME on that JUDGE and SHAME on the FATHER. GOOD LUCK KELLY – HOPE YOU GET YOUR CHILDREN SOON

Children do not need both parents equally. They need their primary
attachment figure more than the other parent and the safe parent more than the
abuser. Since the father was kicked out of the United States of America, it was the fathers criminal conduct that “allienated” him from his children. And we still don’t know what he did–but it must be pretty serious to have our country say we don’t feel safe having you in America.

It is reported that Giersch has been barred from entering the US and his visa was revoked because Kelly Rutherford accused him during their divorce of dealing drugs and weapons, which although as far as we know those are just unfounded accusations. He was never charged . Inncent until proven guilty. So it is her actions which have caused him to not be in the US, check your facts. Chidlren dont need to be exposed to the media as they have been because she has appeared on any talk show that would have her, best move is to get those kids away from the media hype.

I wish Katie had asked the hard questions, Kelly lost custody because she is not the best parent to look after those children, she has only tried to alienate them from their father and been on a media circuit ever since. The judge got it right.

There is nothing like narcissistic ignorance laced with outright untruth, misinformation and apology for an abuser………just like Kelly Rutherford, so goes all of her supporters commenting on this blog, so goes all child-haters……..Children Need Both Parents….but they don’t need to learn how to be narcissistic ignorant liars like Kelly Rutherford was teaching her children until the Judge said enough is enough……..

@Nutured Parent, your response sounds very “textbook.” The fact of the matter is BOTH parents have the right to be active participants in their childs lives. The mothers do not automatically get all of the rights and the fathers, just pay the money. Im a woman by the way… and guess what and educator as well, and I can tell you that children who suffer from low self esteem come from all walks of life. Kelly atempting to cut her childrens father completely out of their lives would have done far more damage to them than simply deeming her the parent that had the most attachment to the child in the first two years. A child is a product of two people….. not the property of one parent by process of elimination…….Kelly was cutting a fool even befor her second child was born. She didn’t even follow the order to notify dad of his owns childs birth….HIS BIRTH…so cut the textbook explanations of what would be right. She should have been sharing custody to begin with like SHE WAS ORDERED too, and she would not have lost her kids!!!

Hello Temp Simms,

I responded to your post because I am hoping to shed some light on the subject. My response is coming from the heart and gained from experience in these matters.

From what I have read, at no point did Kelly attempt to cut the children out from their fathers life. His VISA was revoked by the U.S. Our own country does not feel it is safe to have him here in the United States. That is alarming. And, as his publicists speculate that Kelly had something to do with it, why havent they proved it? That would be information that the court and the public should have to put this matter to rest. Instead, this dad would not disclose to the court or counsel why he was deported.

Both victims’ rights advocates and survivors of domestic abuse hear about (and live) the horror of judicial misconduct day after day, but Kelly Rutherford’s case is particularly alarming:

1. A judge effectively deported two American citizen children to accommodate a man who has been kicked out of the US; and the reasons for his forced departure from the US are unclear, which raises serious concerns about the children’s safety and well-being.

2. The judge’s ruling is unprecedented and goes against the weight of ALL legal authority.

3. The judge forced two American children (3 and 5 years old) to live in France without their mother even though the children’s own counsel recommended that they stay in the US with their mother.

4. Kelly agreed to bring the children to visit their father frequently, (and did so, to Bermuda monthly), but her offer was rejected.

5. Requiring the children to live in France is particularly dangerous because France is not obligated to respect American Court orders which means France officials could modify the custody and visitation decision at any time, without recourse for Kelly or her children.

Lack of oversight and accountability in Family court proceedings across the United States has led to continuous devastation for parents and their children. What we really need is Family Court reform.

The best solution when determining the best interests of the children is to require that safety be the first priority. This is a strong argument because how can anyone argue against it. Safety, however not only means that the child won’t be beaten or neglected, but that the child won’t be placed in circumstances that increase their risks. Kelly’s babies are in another country, and are living with their grandmother and the grandmother’s boyfriend. It is not the father’s home. Who can guarantee their safety in this situation–the U.S. Judge that ordered them there? If anything happens to those children, the Judge will recuse herself–freely walking away without any accountability. Another solution of paramount importance when determining the best interest of children is the role of the primary attachment parent. Primary attachment concerns which parent provided most of the child care in the first two years of the child’s life. That parent is ALWAYS the primary attachment figure even if the custodial arrangements are later changed. Children separated from their primary attachment figure are more likely to suffer low self-esteem, depression and suicide when older. That is a safety issue. So much of what court professionals focus on are not safety issues. This needs to change. The safety and psychological needs of a child MUST come first.

Oh please shut your trap, you are the narcissistic and ignorant one. Where does it says she tried to keep him from seeing the kids. His publicist says that she reported him, but it was never proven. And he never disclosed to the court the reason why he was deported. You need to get you fact straight. That judge was wrong and unjust. Instead of trying to find the middle ground. And the kids are the ones who will suffer the most. But I guess that judge did not think before ruling. Just like you birdbrain

When is this COUNTRY going to come together for “OUR PEOPLE?” Sick of hearing about IMMAGRANTS! Stay home! We need to worry about ‘OUR OWN”! Look what is happening! I vote NO on IMMIGRATION! We have enough of our people that have lost jobs. Now children? What is going on in this country????? Watch who you talk to and sleep with.

She was NOT obliging by the custody agreement. That is why the judge got fed up with her and gave the children to dad. She violated several court orders over and over again, and now she wants everyone to feel sorry for her, and I don’t…… Quit using your children as weapons. THEIR OWN father could not see them. She was accused in a last desperate attempt of tipping off the police about his citizenship and off he was sent to France, but she didn’t count on a judge looking at all the times SHE, not he violated court orders, and yes the judge got fed up and gave custody to the father. Quit leaving out details KELLY!!!! You see she has not won an appeal yet!!!! Nor has the judge been accused of any wrongdoing! MAybe if she tells everything she did wrong, people will start to feel sorry for her…………

Kelly STOP LYING.
You know why Daniel’s visa was revoked, YOU GOT IT REVOKED.
You told INS he was an international drug dealer and money launderer
so that is why his visa was revoked.

The judge ordered you to call Daniel in June 2009 when you went
into labour which YOU DIDNT DO.

The judge ordered you to add Daniel to Helena/Hermes
birth certificates WHICH YOU REFUSED TO DO.

You had a PI follow Daniel and that isnt cool. You wre reprimanded for that
and almost cited for custodial interference.

You still refer to H/H as ‘my kids’ when they are
BOTH YOU AND DANIEL’s KIDS!

The best interest is for kids to have BOTH parents.
You stopped that possibility bc YOU got Daniel deported.

I think you should stop the press tour & focus on getting more work
(gossip girl is thankfully over) so then you can ask for H/H to
come over for holiday they will be able to come. Bc remember you claimed
‘daniel is making me go bankrupt with this custody battle’.

Raising kids in Monaco/France is great and theyll learn French too!

there’s more to this story. she accused him of drug trafficking and was obliging by the custody agreement, judge got fed up. They said she cared more about her career. Not right, but still it happened.

Something is really missing from this story. She did oblige by the custody agreements, by taking the to spend time with him in what ever country he was in at the time for vacations. If she did accuse him of drug dealing and he got deported then there have to be some proof to back it up. I doubt the government goes on the say so of just one person. In court Daniel was asked what he does for a living and he refused to answer. I find it strange that the kids were deported to a country that is not even their fathers country, but their grandmothers I think. This is a mess….I wonder if she ever ill treated them. If the kids court appointed lawyer advised the judge not to send them and she did then there is really something missing

This makes no sense! There must be more to this story. Why was she not awarded custody of her children to begin with??? Why is her husband allowed to live in France if he is not a citizen??? Why aren’t her children, who are American Citizens living in AMERICA??? WTF is wrong with that judge???

1) KR did not respect the court orders, and spread falsehoods about your ex. 2) KR treat your children no privacy. These paparazzi photos are ordered. 3) Monaco / France is much safer than this violent USA. 4) Why should not live a German Citzizin in Monaco ? Many nationalities live there, as well as in New York. 5) Why do not move KR to France?

I CANNOT BELIEVE THAT JUDGES ARE NOT HELD ACCOUNTABLE FOR THEIR ACTIONS. IF HE WAS KICKED OUT OF THIS COUNTRY HE MUST HAVE DONE SOMETHING ILEGAL. THE CHILDRENS RIGHTS AS AMERICAN CITIZENS, AS WELL AS KELLY RUTHERFORD ARE BEING TRAMPLED ON FOR SURE. MY QUESTION TO YOU KATIE, ARE YOU GOING TO HAVE A FOLLOW UP ON THIS? I AM SO INTERESTED TO KNOW. THIS WAY OF LIFE HAS TO AFFECT THOSE CHILDREN EMOTIONALLY, NOT TO MENTION HER’S.

Yes, it would be great to have a follow up on the Katie Couric Show about this case, or better yet, a show that they can investigate these issues–such as Bill O’Reilly. That way we can have a discussion based on evidence–not hearsay.

That Judge should be tossed out of the US

How is this even possible. The father is not a citizen of France these kids are AMERICAN CITIZENS and a JUNGE orders them to be deported over to France with the father? What the hell was that judge smoking, snorting, and injecting? He was tossed out of the US because the father is shady. Poor kids, poor Mom.

I think Fathers get the raw end most of the time in custody cases, but this was ridiculouse.
