If Halle Berry‘s ex-boyfriend Gabriel Aubry wants to spend any more time with his adorable daughter Nahla, he will have to go to anger management classes.  HollywoodLife.com spoke to some top lawyers and here’s what they had to say about the unfortunate incident, especially for little Nahla!

Halle Berry Files Restraining Order Against Ex, Gabriel Aubrey

Los Angeles attorney, Mychal Wilson, tells HollywoodLife.com exclusively, “The incident is advantageous to Halle Berry because she filed a temporary restraining order against Gabriel Aubry after the Thanksgiving fisticuffs between Aubry and her fiance Olivier Martinez. Apparently, the judge granted Halle an Emergency Protective Order where Aubry must stay at least 100 yards away from Berry, Martinez and Nahla. The incident played right into Berry’s attorney’s strategy of painting Aubry as a mad man with a violent temper. So, presumably, Halle Berry will now seek a ‘Permanent Retraining Order’ against Aubry evidence by the criminal battery charges that Aubry may face.

“However, the court will generally rule in the ‘Best Interest’ of the child which is generally means joint custody by both parents,” explains Mychal. “So, Aubry will probably have to take anger management and/or parenting classes to assert his physical custody rights with Nahla.”

Will the Thanksgiving Day Fight Affect Halle Berry’s Custody of Nahla?

Attorney at Law Raoul Felder tells HollywoodLife.com exclusively, “This will most likely not affect Halle’s custody of her child. It will most certainly affect Gabriel’s right to custody. He may not be able to be alone with the child in the future. There’s a good shot of no joint custody. And it’s likely that there will be orders of protection, and Halle and Gabriel may no longer be able to be in the same room.”

When asked if this means Halle would be able to move to Paris now with Oliver, Raoul replied, “That may now be up for grabs. Paris may be rethought.”

Child Protective Services Investigates

HollywoodLife.com also spoke with Armand Montiel with Child Protective Services in Los Angeles who told us, “When the CPS are sent to investigate, all parties involved are questioned. Once the child is above the age of 3 or 4 – if they are at an age where they can talk – a limited interview is had with them. We ask them what happened. If is deemed necessary that the child should be removed from their custodial parent, then we do that, and they are usually placed with a relative. If it is decided that the care the child is receiving is not adequate, then a detention hearing will happen. At the detention hearing, the custody of the child will be decided by the judge.”
