Kelly Rutherford: Losing Custody Of My Kids 'Makes No Sense'

Kelly is not happy with a judge’s ruling, granting ex-husband Daniel Giersch custody of their two children. The ‘Gossip Girl’ star recently revealed to the ‘Today’ show that the ruling ‘makes no sense.’ Read on for more details.

Kelly Rutherford sat down with Savannah Guthrie on the Sept. 20 episode of Today. During the 7 A.M. hour, Kelly admitted that her kids are “doing okay,” but losing her children to ex-husband, Daniel Giersch, “makes no sense.”

The judge in this custody battle ruled that Kelly’s children, son Hermes, 5, and daughter Helena, 3, would have to live in France with her ex, instead of continuing to be raised here in NYC. But Kelly, like millions of others, are baffled with this ruling as both parents were deemed “great parents.”

“It makes no sense. I have a job — a contract,” Kelly said as she expressed the difficulty with seeing her children while they’re in France.

Daniel’s VISA was revoked and until he regains it, his children will “temporarily” live with him in France. Kelly’s concerns come from the fact that “he has no motivation to get back in the country.”

Daniel and their two children are currently living in his “mother’s boyfriend’s home.”

Kelly originally “proposed a 60/40 schedule” which she states is a best-case scenario situation when two parents are living in two different countries.

Kelly is hoping for the best and is currently appealing the case.

It happens everyday. Im a 32yr old mom who had her two children kidnapped at the airport, and now the judge gave them to their father…a man on federal probation for drug trafficing. Im not a criminal have no real criminal record or drug any thing on my record. The judges are nuts and the documents are all proof of the crookedness going on in court. Its the truth of the courts these days and there is seemingly nothing you can do…especially when you are not financially able to afford the attorneys necessary to have them given back. It ‘s wrong And leaves a hole in your heart that no one can imagine. Alicia

Kelly, it may be in your best interest to have your attorney’s file with the court a Statement of Decision. This will force the judge to state on record, using laws governed and outlined by the state of California, the basis of this horriffic decision. Only then, will you have the ammunition needed to fight. Afterwards, file an appeal.

The courts are rampant with corrupt judges. Specifically, family law because, judges have the most discretion in this annex. This ruling is completely unjustified, giving further weight to the fact that, the courts are in a crisis and need to be audited by an oversight committee. Judges are abusing their positions and failing to protect the very litigants that, voted them into office. Moreover, judges are not being held accountable by the Commission on Judicial Performance. Another agency with questionable, biased and, prejudicial practices. Citizens, litigants alike must not give into doubt, depression when faced with adverse rulings. Instead, you must stand against injustice and expose said wrong doings in every way possible. Most importantly, you must never give up. Kelly, I’m saddened to hear of this awful separation. I can only pray that, you have the strength and courage to fight for your babies.

good GAWD!!! i am SO sick and tired of hearing her whine and try to get attention. did you guys know thst she didnt tell the father of her baby that she was in labor and when helena was born? she also said stuff that caused his visa to get revoked. keep playing the victim card kelly, but a lot of people see the REAL you

My goodness… all judges over 60 shd be ” put down ” I swear they loose all common sense after being so JUDGEMENTAL all the years they serve !

I saw a bit of her interview and can’t help but wonder what the judge was thinking.

In almost 90 percent cases, underage kids are supposed to be under their mother’s custody.

So not fair.

The authorities must look in on this. How responsible can this lady’s ex be if their kids are currently live at their daddy’s mom’s boyfriend’s home?!

I just watched her interview and that poor woman looks like she has been through hell! I to would be on every show trying to get the word out on this injustice! This judge is so wrong and should be investigated. The biggest question is why a man who has had his visa revoked and has provided no reason why is getting custody of two young children?

True. What bothers me is that, he never answered what he does for a living. The judge was understanding of this, as he might perjure himself…REALLY? The US state department revoked his visa, not because he overstayed, but because he has shady business dealings, yet this judge gave them away. In the Caribbean we joke about the fact that come what may anytime there is unrest any where America comes for their ppl. This judge just sent AMERICAN kids to live in France with a man who has no address. SHE SHOULD BE INVESTIGATED
