
Kelly is not happy with a judge’s ruling, granting ex-husband Daniel Giersch custody of their two children. The ‘Gossip Girl’ star recently revealed to the ‘Today’ show that the ruling ‘makes no sense.’ Read on for more details.
Kelly Rutherford sat down with Savannah Guthrie on the Sept. 20 episode of Today. During the 7 A.M. hour, Kelly admitted that her kids are “doing okay,” but losing her children to ex-husband, Daniel Giersch, “makes no sense.”
The judge in this custody battle ruled that Kelly’s children, son Hermes, 5, and daughter Helena, 3, would have to live in France with her ex, instead of continuing to be raised here in NYC. But Kelly, like millions of others, are baffled with this ruling as both parents were deemed “great parents.”
“It makes no sense. I have a job — a contract,” Kelly said as she expressed the difficulty with seeing her children while they’re in France.
Daniel’s VISA was revoked and until he regains it, his children will “temporarily” live with him in France. Kelly’s concerns come from the fact that “he has no motivation to get back in the country.”
Daniel and their two children are currently living in his “mother’s boyfriend’s home.”
Kelly originally “proposed a 60/40 schedule” which she states is a best-case scenario situation when two parents are living in two different countries.
Kelly is hoping for the best and is currently appealing the case.

It happens everyday. Im a 32yr old mom who had her two children kidnapped at the airport, and now the judge gave them to their father…a man on federal probation for drug trafficing. Im not a criminal have no real criminal record or drug any thing on my record. The judges are nuts and the documents are all proof of the crookedness going on in court. Its the truth of the courts these days and there is seemingly nothing you can do…especially when you are not financially able to afford the attorneys necessary to have them given back. It ‘s wrong And leaves a hole in your heart that no one can imagine. Alicia
