Kelly Rutherford Cries On ‘The View': My Kids Could Disappear

Poor Kelly Rutherford. She recently lost residential custody of her two small children, and now her daughter is begging to come home. Watch the emotional clip.

Kelly Rutherford was devastated after a Los Angeles judge ruled in August that the best interest of her two young kids Hermes, 5, and Helena, 3, would be to live with her ex-husband Daniel Giersch in France. Although they have joint custody, Daniel cannot return to the US due to a revoked visa. An emotional Kelly visited The View on Sept. 13 to tell her side of the custody battle, and why she fears for the safety of her kids.

The custody dispute began when Kelly left Daniel, and she said he immediately went on the defensive.

“I left when I was three months pregant, because I was pretty scared about what I was finding out about him, and strange things happening,” she said on The View. 

But since Daniel cannot travel to the United States, and Kelly can only see her kids when she visits them in Monoco. She saw them about a week ago, and said her kids are begging to come home to New York, although she believes her son is being brainwashed.

“I dont think he would intentionally harm the children or I couldn’t live with myself right now, but I do think that they are at risk,” she said.

“I was the primary parent, and now I’m the visitor, and there are a lot of things being said every day that we all hear, and they aren’t things that kids need to hear,” she added.

But her worst nightmare is that she could lose her kids forever.

“My fear is that he could dissappear tomorrow and I don’t know where to look. There’s no way to trace him. There’s no bank account numbers there’s no taxes, there’s nothing.”

When asked how she plans to win back custody, she said she’s not quite sure, but that she’s working hard to appeal the ruling. “I’ve been through pretty much everything,” she said.

During the Aug. 28 case, Judge Teresa Beaudet defended her decision, calling both parents, “exceptional,” and “excellent.”

“The relocation decision this court makes today, is without doubt one of the hardest decisions this Court has had to make in its nearly three years in family law,” she stated in court documents, according to E! Online.

“The best interest of the children will be served because the relocation plan for France is the only plan that offers the possibility of nearly equal parenting time while Daniel cannot return to the US,” the judge said. “Once Daniel can return to the US, the parties have agreed to equal parenting time.”

silverfish, part of me agrees with you- but only the part who wanted to be objective and think about if she made up the allegations that caused his visa to be revoked. if she did not make that stuff up- then this is in no way her fault. if he is in fact a dealing crook, of course he was hiding all of that from her when she was deciding to start a family with him… and then, suddenly, with time, he lets his guard down and she starts to get a sick pit in her stomach wondering what the hell this guy is doing? what is she supposed to do? just act like nothing happened? i don’t think she can be faulted for this outcome, and what is hideous is that she now is in the position of having to try to get the guy’s visa back so that she can have more control over her kids- but if she thinks he’s a crook, what is she supposed to do? lie? revoke statements? i mean— if the woman is not lying about this guy, this is a horribly scary position to be in. that said, maybe she is lying… i don’t think if i were in her position i would be talking about this in interviews- which makes me wonder if she is lying/manipulating. it’s very hard to know the truth.

IMO: It’s entirely Kelly’s own fault. If she would have left well enough alone and not had her ex’s visa revoked then maybe the judge would’ve had sided with the husband. Some women just don’t know when to quit…..take note Halle Berry, you’re next with your ex getting custody of your/his child. When you choose to lay with someone and make a child don’t expect that man to just walk away from his child because YOU’RE done with him. I feel sorry for Kelly but she pushed the issue and look where it got her!

she didn’t lose them- but the father can’t come to this country so the judge thought it would be more fair to have the kids with him abroad b/c kelly can travel. she didn’t lose them- it was a custody dispute and they were both pursuing the kids. they both won, but b/c he can’t travel here- the kids have to be with him there. the judge should’ve commented on the merits of the visa revocation. well, i guess that she thinks the kids are safe with him in france, maybe she thinks there isn’t any merit… who knows.
