Kelly Rutherford Reunites With Kids In France After Losing Custody

The ‘Gossip Girl’ star was reunited with her two kids over Labor Day weekend after losing residential custody to her ex-husband Daniel Giersch, which forces the children to remain overseas. Read on for all of the details.

Kelly Rutherford visited her two kids Hermes, 5, and Helena, 3 on Sept. 3 for an emotional reunion in France, where the little ones showered their mom with hugs and kisses. The trip came shortly after a devastating court ruling on Aug. 28 that gave her ex Daniel Giersch residential custody, meaning the children must remain overseas.

But the Gossip Girl star, 43, is fighting to regain custody. On Aug. 31, she asked the judge for a stay to allow the kids to be back in New York to start school while she appealed the custody ruling. However, the stay was denied.

The judge also ruled that in order for the ex-couple to have 50/50 custody, the kids must stay in France with their father — who is banned from the U.S. since his visa expired — and Kelly would have to travel back and forth.

“Kelly is grateful for the outpouring of support from her friends and legal experts who are shocked that American citizen children can be ordered to live in France simply because their father is banned from entering the U.S.” David Goldin, Kelly’s spokesperson, told EXCLUSIVELY.

With the stay denied, Kelly lost her last chance of having her kids back in New York before school starts.

“They went away for the summer to visit their dad and now all of a sudden they are starting school in France, so I think it shocked everyone,” Kelly told Good Morning America during an interview on Sept. 1.

“I’m all for 50/50 and all for children having a mother and father and co-parenting — it’s just that the way it’s set up now — I’m a working mother. I’ve been the sole supporter of my children for their entire life,” she said in the interview.

“I have a job, so I mean I’m going to do my best to be there obviously every chance I get, but I can’t just be there on a regular basis when I have to work and — I mean, I just can’t pick up and go, you know, that easily.”

Today, while I was at work, my sister stole my iphone and tested to see if it can survive a 30 foot drop, just so she can be a youtube sensation. My iPad is now destroyed and she has 83 views. I know this is entirely off topic but I had to share it with someone!

So tired of hearing this GOSSIP GIRL ‘PR campaign’ for Kelly. I feel she is using ‘this situation’ that is not a whacky situation at all…But is certainly making herself look whacked out. .
Father and Mother get joint custody.Period. If Father and MOther reside in different Countries, the children still get equal time with both parents. She did NOT lose custody- ‘she lost control’,and refused to allow the father visitation, therefore ‘she was not dong what is best for the children’. The way I see it, if she really really wanted to be a full time Mother- she should move close to the father of her children for the next 10 yrs…then go back to silly acting. It’s not like she is Anjolina Jolie and bringing home the big paychecks. She does not have to work ‘for money’. I would tend to beleive by now, she has made plenty of money and the childrens father is a multimillionaire to boot! i i PERSONALLY SAY…”KELLY GET OFF YOUR HIGH HORSE AND STOP BERATING THE CHILDRENS FATHER- IT MAKES YOU LOOK kOOKY as an onlooker.

This sets a bad precedence! As a US citizen, joint custody for two fit parents is best for the children. However, joint custody does not automatically include, “if one parent’s visa is revoked, the kids are forced to live in a foreign country.” He needs to Man-Up and get his visa issues resolved and the children will have two fit parents in their lives.

The father lost his visa! How can U.S. citizens be forced to live in a foreign country? Germany happens to be a great place to take kids in custody suits, to prevent the other parent from having a relationship with their children. A friend’s wife took off to Germany with their two children and the Hague Treaty would not help. He mourned the loss of his children, went to Germany, and gained custody in the German courts but no one could find the mother or children.
