HollywoodLife.com has just learned that although Tom and Katie reached a divorce settlement on July 9, they will not be officially divorced until the Fall.
Tom Cruise and Katie Holmes aren’t divorced just yet. HollywoodLife.com spoke with Malcolm Taub, a top family attorney and partner at Davidoff Hutcher & Citron LLP in New York, who tells us that also they reached a divorce settlement very quickly, the divorce itself will take time to be finalized.
“Now that Tom and Katie have settled and signed a stipulation of settlement, the next thing is to process the judgement of divorce,” Malcolm tells us. “This will happen in two to four months. Now that the divorce is pending, what is left is the administrative process. They will file certain papers, then it goes into the matrimonial clerks office and goes in a pile. There is no judgement of divorce today.”
Malcolm definitely believes that Katie’s aggressive legal action forced Tom to settle faster than usual.
“I think that is absolutely the reason why this was settled so quickly,” Malcolm says. “I didn’t believe money was the issue. Katie outflanked Tom and she moved quickly and moved decisively. The fact is, Katie was a very active mother and obviously she was taking an aggressive stance. Why would he want to get into a custody battle?”
But Malcolm says that although a settlement as been reached, the custody agreement will start now.
“In all probability the custody issue has been determined and takes place immediately,” Malcolm explains. “What happens with financial support may take time.”
