HollywoodLife.com told you FIRST that Katie’s divorce battle will ‘undoubtedly’ stay in NYC, and now the actress will formally be requesting temporary child support in the city in a move to protect her 6-year-old daughter Suri.
As HollywoodLife.com exclusively reported, Katie Holmes will have home court advantage — she will be in a family law courthouse in New York City on July 17 for her first divorce hearing against her estranged husband Tom Cruise.
According to RadarOnline.com, Katie, 33, has gotten “top notch legal advice” because the case will remain in New York for the near future.
“Katie clearly has the upper hand in the proceedings at this point. It can’t be emphasized enough that she took these extraordinary measures to protect her daughter, Suri,” said their source close to Katie.
She is reportedly requesting temporary child support to cover living expenses and the added security she has hired since her split from Tom.
Katie’s deck is stacked higher because she had her legal team formed before Tom. We reported that Tom, 50, wanted to file in California, but he couldn’t go as planned because it isn’t possible to file in separate states at the same time.
“Tom’s Los Angeles lawyers have officially been given notice. Tom’s New York lawyer will appear and it’s undetermined at this time if Tom will be in court also because he is currently shooting a movie,” said the source.
“Tom will have to file a formal response to Katie’s divorce petition in New York, and he is going to submit a motion to have the case dismissed because he believes it isn’t the proper venue. Tom is hopeful that New York will do the right thing and allow him to file in California,” the source added.

Can this child walk? I always see her in the arms of her parents. Does she have a physical disability. If not..isn’t she a bit too old & too big to be carried around? If she has a disability my heart goes out to her & her parents. If she doesn’t..what’s the reason for it?

ha, she needs to requ child support..she’s a lousy actress..and needs all the help she can get..i have no Idea What tom was thinking when he married her..yet he had 2nd thoughts for sure..no man makes a lady he loves wait to get married that long after he finds out she’s pregnant!

Tom probably wants the divorce to take place in California so he can screw Katie from what is rightfully hers, like I’m sure he did with Nichole.

How funny and ironic that after years of you calling every shot, controlling Katie’s every move – even going so far as to change her name to Kate – she’s totally gotten the upper hand with you now. And she has the overwhelming support of the public. The only support you’re going to get is from your fellow CO$ crazies. Thought she wanted to distance herself. Why asking for such exhorbitant child support? Obviously she knows she will get no jobs due to no talent. And, put that kid down and let her walk for heaven’s sake!!!!
