Can Tom Cruise Kidnap Suri Cruise From Katie Holmes?

HollywoodLife.com spoke with three top divorce and family attorneys, who tell us that if Tom takes Suri without Katie’s knowledge, she can go to the police and allege kidnapping — read on for all the details.

Katie Holmes is with Suri Cruise nonstop. Do you think the 33-year-old is worried that her soon-to-be ex-husband Tom Cruise is going to kidnap their six-year-old daughter Suri? Vikki Ziegler, a top New York divorce attorney tells HollywoodLife.com what Katie should do!

“It’s unlikely that Tom is going to come and try to take Suri away given he’s in Iceland on a movie set,” Vikki tells us. “But if she believes there’s a threat she can go to the police department and say ‘I believe Tom may come and take my child’ and put them on notice. She can request an emergency hearing to try and get physical custody.”

If Tom wanted to come and take Suri, Katie would have to say it’s okay. According to Vikki, Tom has every right to spend time with Suri but if he took Suri without Katie’s knowledge, Katie could allege kidnapping.

“She would have to go to the police and file kidnapping charges. And then go to the courthouse and file an immediate order of sole custody,” Vikki says. “If Katie’s position is that she and Suri live in NYC and Suri’s taken without her consent … she could say it’s kidnapping and that he’s unstable.”

Malcolm Taub, partner at Davidoff Hutcher & Citron LLP tells HollywoodLife.com that Katie has every right to say ‘No’ to Tom if he asks to see Suri.

“She has the right to say no,” Malcolm tells us. “The law favors common sense. Technically they are on even playing field but if she can prove that the child might be in danger, for instance Tom has the capacity to hire private planes that aren’t subject to normal screening procedures. The reality is if there is a reasonable basis that he may kidnap the child, no one is going to do anything to promote that.”

Even though Katie has filed for sole and primary custody, Vikki tells us that doesn’t mean anything as of yet.

“As it stands, now they share this child,” she says. “That’s just a petition that will be handled in court. It doesn’t mean that Katie will get that. She would have to file an immergent application with the court and say Suri is in real danger. The child has to be in danger or there is immediate harm to the child.”

If Tom asks to have Suri for a night or more and Katie says no … Tom can take Katie to court.

“Right now the only way is if Katie tells him yes,” she says. “And if she says no, he will file for an emergent hearing to get temporary sole custody of Suri.”

Dr. Sheila Forman, LA based Clinical Psychologist and attorney at law tells HollywoodLife.com that it’s no uncommon for a parent to kidnap their own child.

“The most common form of kidnapping is parental kidnapping,” she says. “He still has joint legal custody which means he has the right to make decisions. Right now he still has legal rights to the child. If either one of them step in and file for emergency custody of the child, then they’re violating and it’s kidnapping.”

Malcolm tells us that no matter what, it’s going to be a big battle.

“Custody cases are always terrible for all parties,” Malcolm says. “There is no good custody battle.”

I was skimming through this article… and I want to point 1 thing out. Tom is the father of Suri and it is not considered “kidnapping” her if there is no custody established. So…, if he shows up one day and physically takes his dauther from her and she reports it to the police they will not do anything because he is the father and that is not conisdered kidnapping. If that happens he could get temporary physical custody until the trial happens. I am not sure how fast things happens for celeberties regarding the court process… however, for a regular person it takes btw 3-5 months to just to get a trial date. My advice (which is not legal advice) is until custody is established is to keep her daughter close to her and not let him see her until the custody matter is established. No court is going to see it as her trying to isolate her from her father because of how the legal system is set up.

Until the Divorce is finalized, Tom could take Suri and it would not be kidnapping. It would be childnapping. In addition, once a divorce is filed in one state, the divorce proceedings stay there. Unless, neither party meets the requirements to file in that state.

Suri, is carried quite a bit, however; I carried my 2nd son as much or possibly more. It was necessary. He would run into the streets, (including Manhatten). I carried him to keep him safe. He was born hearing & quickly became deaf. PE tubes alleviated the hearing problems, but not the developmental delay. He was impulsive too. We always had his little cars with us, which were his blanket. Often times in a busy city, it’s just plain safer to have them in your arms or in a stroller. Katie, in my opinion still loves Tom: yet, she is putting her daughter first. Like any great mom. If the love is gone…she is an AWESOME actress, with a level head and much patience. Tom is a great actor, who unfortunately has his priorities mixed up. No person should allow a religion to CONTROL them to the degree he has allowed. It seems that he has severe ADHD. Too bad he isn’t “allowed” to try Ritalin. Personally, I’m grateful his beliefs aren’t like the extreme Islamists.

No. She isn’t carrying the kid everywhere. Now if she did that every day or something it would be weird. They are just playing around. Finally. Something that Katie and Suri never did before. You must not have kids. Or even friends if you think horsing around is bad.

Why is the father of this child being portrayed as crazy? I mean, previously, what is now being called “crazy” was described as passionate/ intense/devout. Why would a megastar “Kidnap” his child. This is some anti-father garbage. There have been no reports that Tom Cruise is a bad father. He has every right to see his child, and while she is with him if he attends a COS service, he has every right to bring the child with him. Katie Holmes will win nothing by trying to attack Tom’s right to freely practice his religion.

No it is not crazy and unless you are a member of his church you have no idea what they are capable of. Even many members don’t know the extent they will go. Katie should do everything she can to protect her child.

That religion is definitely not safe for the wellbeing of the child. That religion has been outlawed in Germany, England and several other countries. Its not a religion its a cult. Big difference. In any case, we have all seen that Tom Cruise disrespects all opinions but his own and Scientology. Its not about the father or the mother. Its about the welfare of the kid.

There are plenty of awful practices that are simply parts of even mainstream religions that no real parent would allow, but some do non the less. Most of them to women by men. There is female circumcision that leaves a woman unable to enjoy sex for her entire life. There are religions that say that if a girl has sex before marriage she should be killed by her family members( the male ones). These are all things that fathers inflict on their daughters. I am not saying Tom is doing anything like that, but the idea that fathers should be allowed to do whatever their religion says to their daughters is a very poor argument.

You obviously know nothing about Scientology. Also Tom has gone for months at a time away from his child while filming movies so it’s not like he hasn’t had time away before and this is something new.
