As of Dec. 14, Gary Shirley now has custody of his daughter with Amber Portwood and the Department of Child Services has dropped the investigation against Amber and Gary, Gary’s attorney tells exclusively.

It’s official. Leah, 3, is now living with her dad, Teen Mom star Gary Shirley. Her mom, Amber Portwood has visitation rights, Gary’s attorney, Jeff Lockwood, tells exclusively.

“Today the Department of Child Services dismissed their case against both parents,” Lockwood tells us. “Now that DCS is out of way, regular court order comes into play.”

He explains, “Gary is the primary custodian, which means he has custody of Leah and Amber has visitation rights.”

At this point, Lockwood shares with us that Leah will be with Amber every other weekend, Friday through Sunday, alternating holidays and time in the summer.

“Gary loves Leah very much. In my opinion, he still has strong feelings for Amber,” Lockwood says. “Whatever her struggles are, he wishes her the best and supports her, but his primary concern is protecting Leah.”

We’re so glad Gary and Amber have reached an understanding when it comes to their baby.

This is such a sad situation. I will not even pretend to know what actually goes on in Ambers mind, but it always seems to me she says she loves leah, but much of that seems to be an act. I’m not sure if its that she just doesn’t like her child, or she was just so unprepared to be a mother that she doesn’t know what to do. The fact it this girl has issues. I just hope and pray that she can get through them, and get to a healthier place so she can really be their for her daughter. After all, little Leah is completely innocent in all this. All she did was be born to people who’s life’s were in turmoil. God Bless this little child
