Jenelle Evans cannot stay out of trouble and now she might end up paying for her latest mistake behind bars. As RadarOnline reported earlier today, the Teen Mom star broke the terms of her probation by testing positive for THC, a substance found in marijuana, and her lawyer Dustin Sullivan tells us she’s in deep trouble.
“She is facing 45 days active sentence,” Sullivan says, explaining that her first court date is Aug. 24, at which time she’ll “name her attorney.”
“She probably won’t be taken into custody at that time,” he adds. “She will have a second court date where the judge will decide if she is guilty.”
Her attorney explains to us Jenelle was on probation for pleading guilty to drug paraphenelia posession. If she had completed her probation without violating it, that charge would be dismissed. But if she is found guilty of violating her probation and goes to jail, the charge will be on her record permanently.
“If Jenelle goes to jail, her probation will be done” and the jail time will be her sentence, Sullivan explains.

Its not that “its just pot” its the fact that she is on probation and a condition of her probation is to not smoke pot or do drugs. She didn’t do that so she should have to take responsibility.
