Following Gary Shirley’s May 25 arrest for driving with a suspended license, Indiana CPS has filed a petition to remove baby Leah from his care.
The Indiana Department of Child Services is trying to have Gary Shirley‘s daughter Leah removed from his custody and relocated, HollyBaby.com has learned exclusively, following Gary’s arrest May 25 for driving with a suspended license. “A petition for review of placement has been filed with [an Anderson, Indiana] court,” Gary’s attorney, Jeff Lockwood, confirms.
When asked if CPS will likely remove Leah from Gary’s custody, Lockwood told us, “Not if I have anything to say about it.”
Gary currently has sole custody of his daughter with Amber Portwood, who lost custody of Leah herself after a bout of vandalism against her car and home in early May.
A date for the custody hearing has not been set.
Leah’s life with parents Amber and Gary has long been unstable, but Gary’s arrest is being considered the final straw.
Back in Nov. 2010, Amber was charged with two felony counts and one misdemeanor for domestic violence and battery relating to her attacks on Gary in Aug. 2009 and July 2010. Official documents state Amber choked, slapped, punched and kicked Gary in their home. The felony charge came into effect because Leah was present during the attack.
