Uh-oh! It looks like Gary Shirley may get custody of Leah if Amber Portwood gets thrown behind bars!
Teen Mom star Amber Portwood needs to be on her best behavior because if she gets arrested, she could lose her baby daughter, Leah! On Nov. 18, 20-year-old Amber was charged with two felony counts and one misdemeanor for domestic violence and battery against her baby daddy, Gary Shirley. If she’s booked because of these charges, it could mean that Gary will get custody of their 2-year-old daughter!
According to Ann Houseworth, information officer for the Department of Child Services in Indiana, if a parent gets arrested, that’s when action gets taken. “In general, whatever happens with a criminal case won’t impact our involvement unless the parent is arrested,” she says.
“In a situation where a parent is arrested, DCS would look first to the other parent, if known, for placement,” Ann explains. “In Indiana, custody typically goes to the mother by default if the couple is not married. But once paternity is established then custody can be determined.”
This is how it could go down for Amber: “The prosecutor will issue any warrant on his timetable,” says Indiana Police department detective Mitch Carroll. “Naturally, he can either enhance or mitigate the submitted charges. At the point the warrant is issued, Amber could turn herself in, or be picked-up for arrest.”
Now, this doesn’t necessarily mean that Amber could be booked, but it sure is looking that way. The charges could be dropped, but if they’re not, she’s going to have some serious custody issues to deal with!
