The Academy Award winner is facing a potentially lengthy court battle as his ex, and the mother of his child, Oksana Grigorieva files a suit claiming the actor knocked out two of her teeth and caused her to suffer a concusion.
Mel Gibson‘s lawyers are claiming a restraining order issued after ex Oksana Grigorieva made claims the actor was physically abusive is simply the result of sour grapes over what she views as a less than stellar child custody agreement.
Mel’s lawyer Stephen Kolodny tells TMZ, “Having entered into an agreement that allows for overnight, unrestricted visitation, and would soon result in Mel having 50/50 custody of their daughter — an agreement reached after a two-day mediation with two retired Superior Court judges, Mel was hopeful that their break-up was behind them and Lucia would be the beneficiary of cooperative parenting. Apparently Lucia will be denied that good fortune.”
In papers filed last Monday, June 21, Oksana alleged the actor knocked out two of her teeth and gave her a concussion during an incident in January as she tried to protect the pair’s daughter, now 8-month-old Lucia. The judge issued a restraining order that was later modified to allow Mel contact with his daughter when his lawyers had it challenged. They cited the fact that Oksana stayed with and traveled extensively with the actor after this rumored incident, even though she claimed her life was in danger around him.
Sources close to Mel explain that it was not Mel but Oksana who hurt herself and the child on January 6. They claim, “Mel and Oksana were arguing at home when Oksana took baby Lucia, ran around the backyard, threw herself on the ground, came back inside the house and began shaking Lucia like a ragdoll.” While they admit there was “physical contact,” they insist “Mel did not punch her and was just trying to protect the baby.”
Mel and Oksana separated in May in a deal where Oksana got primary custody of Lucia and Mel visitation, though this would eventually lead to joint custody. Mel was apparently informed he could not see baby Lucia on Father’s Day, something the former couple had already agreed upon, and was served with a restraining order the next day.
It appears this case is far from over.
