Brooke told Police Offier Valerie McFarlane that Charlie grabbed her by the “upper part of the throat while straddling her on the bed” after she told him she wanted a divorce and would get custody of the children. Brooke added that Charlie saying, “You better be in fear. If you tell anybody, I’ll kill you … I have ex-police I can hire who can get the job done and they won’t leave any trace.” Brooke told the officer that she was in fear of her life. She claimed the attack only ended after she told Charlie, “You’re right, you’re right, you’re right … I love you.”
Charlie, however, who was interviewed by Officer Rick Magnuson, claimed, according to the affidavit, that he and Brooke had been “having marital problems lately” and even more shocking, that Brooke “abuses alcohol.” Their argument started around 3:30 AM on Christmas morning, he said, and according to Charlie, the argument was “predominantly verbal” but that they “slapped each other on the arms” during the fight. He did admit that he broke two pairs of her eyeglasses in front of her — Officer MacFarlane later valued those at $520.
Brooke, according to the affidavit, had “red marks on the upper part of the front of her neck.” Mueller told the officer this was “not normal” and that Charlie — who is ID’d in the documents as Carlos Irwin Estevez, his birth name — had caused the marks on her neck.
